Booking and General Terms and Conditions

 

After sending the booking request, the User is obliged to pay.

I. Introductory provisions:

  1. The Terms of Use set out the terms and conditions for the use of information society services available on the website operated by Cyprusbestvillas.com (Mr. Z.   2. A person who uses any element of the Service (hereinafter referred to as "User") shall be deemed to be a user of the Service. A User may use the Service only after accepting these Terms of Use, by which he/she agrees to enter into a contract between Cyprusbestvillas.com and him/her for the use of the Service with the content of these Terms of Use.
  3. com reserves the right to modify or discontinue any aspect of the Service, or to change its appearance, content or operation, at any time without prior notice .

II. Booking, Conclusion of the Contract

  1. Users have the possibility to search for accommodation on Cyprusbestvillas.com.
  2. By completing and submitting the reservation form on Cyprusbestvillas.com, the User indicates his/her intention to make a reservation.
  3. The Service is available to users over the age of 18. Cyprusbestvillas.com is entitled to refuse a reservation from a minor (under 18 years of age) or to refuse to accept a minor in the case of a confirmed Reservation, even if the minor is present at the accommodation without the supervision of an adult.
  4. By submitting the Reservation, the User acknowledges that, in case of its acceptance, the Contract between him/her and Cyprusbestvillas.com is concluded on the date, prices and conditions indicated in the offer accepted with the Reservation. The User acknowledges that by sending the reservation, he/she will be obliged to pay. 30% of the total price. Once the payment is received, Cyprusbestvillas.com will confirm the reservation. The contract is active as from the confirmation. So the contract will become active when the 30% deposit is received and Cyprusbestvillas.com confirms the booking by email. (Please also check "Spam".) If you do not receive the confirmation within 2 working days after the transfer, please notify us immediately by email or phone.
  5. If the deposit is not received within 5 working days, Cyprusbestvillas.com will cancel the booking and the accommodation will be made available to everyone again at that time.
  6. The User shall pay the remaining amount (70%) no later than the day of arrival.

III. Cancellation or modification of a confirmed reservation

  1. The User may modify or cancel a reservation made oncom by sending an email (This email address is being protected from spambots. You need JavaScript enabled to view it.) or by contacting the Customer Service. If the exercise of the right of modification or cancellation free of charge is limited in time, the date of receipt of the request for modification or cancellation by email shall be the date of the request for modification or cancellation.
  2. Confirmed reservations can be cancelled free of charge 30 calendar days prior to arrival. In this case, Cyprusbestvillas.com will refund the 30% deposit paid to the bank account provided.
  3. Changes to confirmed reservations can be made free of charge up to 30 calendar days before arrival.
  4. If the cancellation is made within 30 calendar days prior to arrival, the 30% deposit will be paid to Cyprusbestvillas.com as a penalty. In this case the deposit will not be refunded to the User.
  5. If the User fails to arrive at the accommodation despite the accepted Reservation, he/she shall be deemed to have cancelled the reservation. In this case, the penalty will still be 30% of the deposit.
  6. The User shall pay the remaining amount (70%) no later than the day of arrival. Failure to do so shall constitute immediate termination and breach of contract. In this case Cyprusbestvillas.com may refuse accommodation to the User and shall not be obliged to provide alternative accommodation.
  7. com shall immediately notify the User if it is unable to fulfil the original contractual obligation undertaken with the Reservation. In such a case, the Partner shall be obliged to provide the User with a substitute service of the same or a higher standard of accommodation without any charge to the User. The Substitute Service must meet the basic characteristics of the original service (number, comfort level, location of the accommodation, geographical distance, location within the municipality, areas for independent use). Any additional costs incurred in using the Substitute Service shall be borne by Cyprusbestvillas.com. The User is under no obligation to accept the Substitute Service. If the User chooses a higher value service instead of the Substitute Service, the User is obliged to pay the difference in price between the Substitute Service and the higher value service chosen by the User.

IV. Cancelling a confirmed booking

  1. The User's accepted Reservation will be considered as cancelled by Cyprusbestvillas.com and may be cancelled by the User, subject to the following conditions, or alternatively:
    • if the User has provided obviously false information during the booking process;
    • if the deposit (30%) has not been paid by the deadline (5 working days)
    • if the User does not arrive within the check-in time on the day of arrival, unless the User has indicated in advance that he/she will arrive later;
    • if the User cannot be contacted at any of the contact details provided by the User to Cyprusbestvillas.com, despite repeated attempts, and the Reservation cannot be completed in the absence of contact;
    • in the event of force majeure resulting from a natural disaster (technical failure is not considered force majeure) or the application of trade or economic sanctions, embargoes or legal restrictions;
    • if fraud or theft (or any such offences) committed in the course of previous use of the accommodation has been brought against the User and Cyprusbestvillas.com becomes aware of this;
    • in the case of suspicious Reservations that are not reasonably believed to be intended to meet the User's actual needs; or are initiated to circumvent legal requirements;
    • if there is a manifest error in the offer of the Reservation which is recognisable to the User and in respect of which Cyprusbestvillas.com cannot be expected to fulfil the Reservation under the conditions specified (e.g. manifest error in the amount of the Reservation).
  2. If the Reservation is cancelled, Cyprusbestvillas.com. is no longer obliged to provide the accommodation.
  3. com reserves the right, at its sole discretion, to exclude certain Users from the services available through Cyprusbestvillas.com for a fixed period of up to one year, subject to prior notice, in the event of breach of these Terms of Use, the sections of the Agreement relating to cancellation/modification, payment, user reviews, copyright or user liability.

V. General payment terms

  1. According to the information on the Cyprusbestvillas.com profile, after the 30% deposit, the payment of the Reservation Fee can be made (1) in cash at the place of accommodation, (2) by bank transfer to Cyprusbestvillas.com no later than the day of arrival.

VI. User liability

  1. The User shall use the Service only for the purpose of making bona fide and legitimate requests for quotations or Reservations and by using the Service, the User agrees not to make speculative, false or fraudulent Reservations or to make Reservations in excess of the genuine need. By using the Service, the User agrees that the personal details provided at the time of booking, the contact details provided and payment information provided are correct. The User is solely responsible for any damage resulting from the inaccuracy of the data provided.
  2. The User agrees to keep Cyprusbestvillas.com informed of any public communications and changes to the Terms of Use and Privacy Policy.
  3. The Service may only be used within the limits of applicable law, without prejudice to the rights of third parties and Cyprusbestvillas.com and in compliance with these Terms of Use. If a User uses the Service in violation of the provisions of these Terms of Use or in violation of the law, or otherwise misuses the Service, Szallas.hu Zrt. may prohibit the User from using the Service, and Cyprusbestvillas.com shall be entitled to take the necessary legal action to hold the User liable. This action may also be taken against the User in case of misuse of other data.
  4. You may not use any system or solution that is intended to, enables or may result in the use of the Service in a manner not expressly permitted in these Terms of Use, or the downtime of servers used to operate the Service, or that otherwise endangers the proper operation of the Service. Accordingly, the use of automated means to perform bulk data mining on Cyprusbestvillas.com, whether for database building or other purposes, is expressly prohibited.
  5. In the event that any claim or proceeding is brought against Cyprusbestvillas.com by a third party or any public authority or court as a result of or in connection with the User's conduct, the User shall take all actions required by Cyprusbestvillas.com and shall compensate Cyprusbestvillas.com for all damages, property damage and costs incurred by Cyprusbestvillas.com as a result of or in connection with any unlawful conduct of the User.
  6. The User shall compensate any material damage caused by the use of the accommodation.
  7. LEGISLATION: In matters not covered by these terms and conditions, the applicable legislation shall prevail.
